By accessing, using, or obtaining any content, products, or services through our offices or through our website, you, the purchaser, and/or traveler (“customer” and/or “you/your”) agree to be bound by these terms. These terms and conditions govern the relationship between www.vacationshut.com and you, the Customer. No alterations to these terms and conditions may be made by any www.vacationshut.com employee, authorized representative, or agent, unless in writing by an authorized officer of www.vacationshut.com.

Website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations, or otherwise transacting business with our suppliers, and for no other purposes. The terms   "www.vacationshut.com" refer to www.vacationshut.com, a California corporation, and its subsidiaries and corporate affiliates, including www.vacationshut.com (collectively, the "www.vacationshut.com, Companies"). "www.vacationshut.com Partner" means any co-branded and/or linked website through which we provide links, content, or service. The term "you" refers to the customer visiting the Website and/or booking a reservation through us on this Website, or through our customer service agents.

This Website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Terms of Use" or "Agreement"). Please read these Terms of Use carefully, as they contain important information about limitations of liability and resolution of disputes through arbitration rather than in court. You should also read our Privacy Policy, which also governs your use of the Website, and is incorporated by reference in this Agreement. By accessing or using this Website, booking any reservations for travel products or services on this Website, or contacting our call center agents, you agree that the Terms of Use then in force shall apply. If you do not agree to the Terms of Use, please do not use or book any reservations through this Website or our call center agents.

RISKS/SAFETY

Travel to certain destinations may involve greater risk than others. www.vacationshut.com urges customers to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, www.vacationshut.com DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CUSTOMER PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT THE CUSTOMER’S OWN RISK.

USE OF THE PORTAL, ACCESS, AND INFORMATION FOR TRAVEL BOOKINGS

You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to make travel bookings with www.vacationshut.com by any means, including our Web site in accordance with all terms and conditions herein. You agree to be financially responsible for all of your travel bookings (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of www.vacationshut.com communications by minors under your name or account. You also warrant that all information supplied by you or members of your household transacting business with www.vacationshut.com is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel services reservations facilities provided by www.vacationshut.com shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act.

Separate supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms and conditions of purchase imposed by www.vacationshut.com and any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase, in your being denied access to any flights, hotels, cruises, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in www.vacationshut.com debiting your account for any costs www.vacationshut.com incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through access provided by www.vacationshut.com.

GENERAL

This agreement is governed by the laws of the State of California, USA. You hereby consent to the exclusive jurisdiction and venue of courts in Los Angeles County, California, USA, in all disputes arising out of or relating to travel bookings with www.vacationshut.com, including the use of the www.vacationshut.com Web site. Use of the www.vacationshut.com Web site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the customer and www.vacationshut.com with respect to travel bookings made with www.vacationshut.com by any means accessing such information, including its Web site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and www.vacationshut.com with respect to communications with www.vacationshut.com, including the www.vacationshut.com website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.

SELLER OF TRAVEL

www.vacationshut.com is a registered seller of travel in California, CST XXXX. The California Seller of Travel laws requires all sellers of travel to have a trust account or bond. www.vacationshut.com maintains a trust account for all client payments and deposits as required.

USE OF THE WEBSITE

As a condition of your use of this Website, you warrant that:

  • you are at least 18 years of age
  • you possess the legal authority to create a binding legal obligation
  • you will use this Website in accordance with these Terms of Use
  • you will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act
  • you will inform such other persons about the Terms of Use that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto
  • all information supplied by you on this Website is true, accurate, current, and complete
  • If you have a www.vacationshut.com account, you will safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you.

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason, including, but not limited to, for violation of these Terms of Use.

PROHIBITED ACTIVITIES

The content and information on this Website (including, but not limited to, price and availability of travel services) as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your travel itinerary (and related documents) for travel or service reservations booked through this Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website. Additionally, you agree not to:

  • Use this Website or its contents for any commercial purpose;
  • Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
  • Access, monitor or copy any content or information of this Website using any robot, spider, scraper, or other automated means or any manual process for any purpose without our express written permission;
  • Violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
  • Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
  • Deep-link to any portion of this Website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or
  • "Frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorization.

If your booking or account shows signs of fraud, abuse, or suspicious activity, www.vacationshut.com may cancel any travel or service reservations associated with your name, email address or account, and close any associated www.vacationshut.com accounts. If you have conducted any fraudulent activity, www.vacationshut.com reserves the right to take any necessary legal action and you may be liable for monetary losses to mywanderlusts.com including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact www.vacationshut.com Customer Service.

SUPPLIER RULES AND RESTRICTIONS

Additional terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. Please read these additional terms and conditions carefully. In particular, if you have purchased an airfare, please ensure you read the full terms and conditions of carriage issued by the Supplier, which can be found on the Supplier's Terms and conditions on the www.vacationshut.com website. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products, or services. Airfare is only guaranteed once the purchase has been completed and the tickets have been issued. Airlines and other travel suppliers may change their prices without notice. We reserve the right to cancel your booking if full payment is not received in a timely manner.

www.vacationshut.com may offer Customers the opportunity to book a reservation for a combination of two one-way tickets instead of a roundtrip ticket. Combined one-way tickets may provide a greater choice of flights, are often cheaper, and can be combined on the same airline or on different airlines. Unlike roundtrip tickets, each one-way ticket is subject to its own rules, restrictions, and fees. If one of these flights is affected by an airline change (e.g. cancellation or rescheduling) that causes a Customer to make changes to the other flight, the Customer will be responsible for any fees incurred for making changes to the unaffected flight.

For certain low-cost carriers, the price of your flight has been converted from a different currency for convenience purposes to provide you with an estimate of the amount of the purchase in your local currency. As a result, when you book, the amount charged to your credit card by the airline may be slightly different due to currency fluctuations. Your statement may also include an applicable fee from your card issuer to process the transaction plus any applicable taxes for international purchases.

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person.

You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier's rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

PRIVACY POLICY

www.vacationshut.com believes in protecting your privacy. Please refer to our privacy policy to review our current Privacy Policy, which also governs your use of the Website and, as stated above, is incorporated by reference, to understand our practices

PREPAID HOTEL RESERVATIONS

You acknowledge that www.vacationshut.com pre-negotiate certain room rates with hotel suppliers to facilitate the booking of reservations and provides services to facilitate such booking of reservations for consideration (the "facilitation fee"). The room rate displayed on the Website is a combination of the pre-negotiated room rate for rooms reserved on your behalf by www.vacationshut.com and the facilitation fee retained by www.vacationshut.com for their services. You authorize www.vacationshut.com to book reservations for the total reservation price, which includes the room rate displayed on the Website, plus tax recovery charges, service fees, and where applicable, taxes on the www.vacationshut.com services. You agree that your credit card will be charged by www.vacationshut.com for the total reservation price. Upon submitting your reservation request you authorize www.vacationshut.com to facilitate hotel reservations on your behalf, including making payment arrangements with hotel suppliers.

You acknowledge that except as provided below with respect to tax obligations on the amounts we retain for our services, www.vacationshut.com does not collect taxes for remittance to applicable taxing authorities. The tax recovery charges on prepaid hotel transactions are a recovery of the estimated taxes (e.g. sales and use, occupancy, room tax, excise tax, value-added tax, etc.) that www.vacationshut.com pay to the hotel supplier for taxes due on the hotel's rental rate for the room. The hotel suppliers invoice the www.vacationshut.com Companies for certain charges, including tax amounts. The hotel suppliers are responsible for remitting applicable taxes to the applicable taxing jurisdictions. None of the www.vacationshut.com act as co-vendors with the supplier with whom we book or reserve our customer's travel arrangements. Taxability and the appropriate tax rate vary greatly by location. The actual tax amounts paid by www.vacationshut.com to the hotel suppliers may vary from the tax recovery charge amounts, depending upon the rates, taxability, etc. in effect at the time of the actual use of the hotel by our customers. We retain service fees as additional compensation in servicing your travel reservation. Service fees retained by www.vacationshut.com for their services vary based on the amount and type of reservation.

You may cancel or change your prepaid reservation, but you will be charged the cancellation fee or changed full reservation amount as indicated in the rules and restrictions on the particular reservation. If you do not cancel or change your reservation before the cancellation policy period applicable to the reservation you reserved, which varies by product (usually 24 to 72 hours) prior to your date of arrival, you will be subject to a charge equal to applicable rates, tax recovery charges, and service fees. In the event you do not show for the first night of the reservation and plan to check-in for subsequent nights in your reservation, you must confirm the reservation changes with us no later than the date of the first night of the reservation to prevent cancellation of your reservation.

You agree to pay any cancellation or change fees that you incur. In limited cases, some products do not permit changes to or cancellations of reservations after they are made, as indicated in the rules and restrictions for the reservation. You agree to abide by the Terms of Use imposed with respect to your prepaid reservations.

Sales, use, and/or local hotel occupancy taxes are imposed on the amounts that we charge for our services (service fee and/or facilitation fee) in certain jurisdictions. The actual tax amounts on our services may vary depending on the rates in effect at the time of your use of the reservation.

You may not make reservations for more than 4 rooms online for the same hotel/stay dates. If we determine that you have booked reservations for more than 4 rooms in total in separate reservations, we may cancel your reservations, and charge you the full reservation fee, if applicable. If you paid a non-refundable deposit, your deposit will be forfeited. If you wish to book reservations for 5 or more rooms, you must contact www.vacationshut.com, group travel specialists by phone at (800) 880-4861. One of our travel specialists will research your request and contact you to complete your reservation. You may be asked to sign a written contract and/or pay a nonrefundable deposit.

Some hotel suppliers may require you to present a credit card or cash deposit upon check-in to cover additional expenses incurred during your stay. Such a deposit is unrelated to any payment received by www.vacationshut.com for your reservation

PAY NOW OR PAY LATER DETAILS

With certain hotels, you may be presented with the option to pay online now or pay later at the hotel. If you select the "Pay Now" option, www.vacationshut.com will charge the amount to your credit card in US dollars immediately. If you select "Pay Later at the Hotel", the hotel will charge your credit card in the local currency at the time of your stay. Please note that taxes and fees vary between the two payment options. Tax rates and foreign exchange rates could change in the time between booking and stay. Coupons may only be applied to "Pay Now" reservations on the website.

UNPUBLISHED RATE RESERVATIONS

When available, www.vacationshut.com’s subsidiary, www.vacationshut.com may offer additional, discounted booking options on the Website. These products, called www.vacationshut.com Unpublished Rate travel inventories, are different from other services offered on the Website in several important ways. The name and exact address of the hotel is not shown until after payment has been made for the booking. All bookings are final and cannot be changed, refunded, exchanged, canceled, or transferred to another party. Your credit or Debit card will be charged for the amount shown even if you do not use the booking. Room type will be determined by the hotel based on the number of guests provided at the time of booking. All reservations are booked for stays in non-smoking rooms (subject to availability). Hotel room assignments are determined at check-in and upgrades are not available. The maximum number of Unpublished Rate rooms that can be booked at one time is four. All Unpublished Rate rooms will be booked under the same name, and the guest under whose name the reservation is made must be present at check-in. www.vacationshut.com unpublished Rate products are not eligible for rewards or club programs. Upon check-in, guests must present a valid ID and credit or Debit card in their name (the amount of available credit required will vary by hotel). Debit cards may not be accepted. For information about tax recovery charges, service fees, and taxes on our services, where applicable, please see "Prepaid Hotel Reservations."

www.vacationshut.com is not liable for any costs incurred due to hotel, spaces, resorts, rental car facilities, or station relocation.

BANK AND CREDIT CARD FEES

Some banks and credit card companies impose fees for international transactions. If you are making a booking from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the figure shown on the billing summary page for a reservation booked on the Website. In addition, a foreign transaction fee may be assessed if the bank that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the bank or card company, since www.vacationshut.com may pass on your payment to an international travel supplier. The currency exchange rate and foreign transaction fee are determined solely by your bank on the day that they process the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank.

INTERNATIONAL TRAVEL

You are responsible for ensuring that you meet foreign entry requirements and that your travel documents, such as passports, visas, and legitimate health-related permits, cards, and repots (COVID-19, transit, business, tourist, and otherwise), are in order and any other foreign entry requirements are met. www.vacationshut.com has no special knowledge regarding foreign entry requirements or travel documents. We urge customers to review travel prohibitions, warnings, announcements, and advisories issued by the relevant governments prior to booking travel to international destinations.

Passport and Visa: You must consult the relevant Embassy or Consulate for this information. Requirements may change and you should check for up-to-date information before booking and departure. We accept no liability if you are refused entry onto a flight or into any country due to your failure to carry the correct and adequate passport, visa, or other travel documents required by any airline, authority, or country, including countries you may just be transiting through. This includes all stops made by the aircraft, even if you do not leave the aircraft or airport.

Health: Recommended inoculations for travel may change and you should consult your doctor for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip.

Disinfection: Although not common, most countries reserve the right to disinfect aircraft if there is a perceived threat to public health, agriculture, or the environment. The World Health Organization and the International Civil Aviation Organization have approved the following disinfection procedures:

1. Spray the aircraft cabin with an aerosolized insecticide while passengers are on board or

ACCOUNT TERMINATION

If you believe that an account holder or subscriber is a repeat infringer, please provide information sufficient for us to verify that the account holder or subscriber is a repeat infringer when filing your notice.

PAYMENTS AND CANCELLATION

Final payment is due prior to departure according to each supplier’s terms and conditions. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits shall be forfeited. As a result of such cancellation, www.vacationshut.com’S and third party supplier’s cancellation penalties will apply, which are detailed in your travel documentation, each supplier’s Web sites will refund you 100% of whatever the supplier refunds to us, except for our cancellation fee as detailed on your www.vacationshut.com invoice. All cancellation fees will be charged to the credit card you authorized to pay for travel services, or deducted from the supplier’s refund. This transaction is not covered by the California Travel Consumer Restitution Fund, and www.vacationshut.com is not a participant in said Fund. If transportation or other services are canceled by www.vacationshut.com, all sums paid to www.vacationshut.com for services not performed in accordance with the contract between www.vacationshut.com and the customer will be refunded within thirty (30) days of receiving the funds from the supplier with whom the services were arranged, or if the funds were not sent to the supplier, the funds shall be returned within fourteen (14) days after cancellation by www.vacationshut.com to the customer unless the customer requests www.vacationshut.com to apply the money to another travel product and/or date. 

Note: UNLESS SET FORTH IN WRITING, AIRLINE RESERVATIONS MAY NOT BE INCLUDED IN YOUR TRAVEL PLANS. 

In such an event, it is the customer’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. www.vacationshut.com shall not assume any responsibility for any air and/or ground schedule changes. Every attempt has been made to include all taxes in your package. In rare instances, certain departure taxes must be paid in cash only, upon departure from a country, and may vary in price.

LATE BOOKINGS

Prospective customers are advised to reserve early to avoid disappointment and additional fees.

TRAVEL DOCUMENTS

It is the responsibility of each customer to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. www.vacationshut.com strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted unless authenticated and verified consent forms are provided to the authorities. Non-United States citizens may require additional documentation. See help.cbp.gov/app/answers/detail/a_id/268/kw/travel and check with your local embassy or consulate. The US Customs and Border Protection Agency requires that for USA child groups under age 19 arriving by land or sea from the contiguous territory and traveling with a school group, religious group, social or cultural organization, or sports team, may also present an original or copy of his or her birth certificate, a Consular Report of Birth Abroad, or a Naturalization Certificate. Parental or legal guardian consent must be provided to the supervising adult/Group Leader.

INDIVIDUAL ENTRY AND EXIT REQUIREMENTS.

Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. REFUND OF UNUSED ARRANGEMENTS

As www.vacationshut.com tour prices are based on contract rates, there will not be any refund for any unused portion of a tour.

ALTERATIONS TO CONFIRMED BOOKINGS.

If you decide to change any portion of your confirmed arrangements prior to departure, we will attempt to assist you at an administrative charge of $150.00 per change.

HEALTH AND SECURITY REQUIREMENTS

It is each customer’s responsibility to make absolutely certain to have the proper immunizations and required documentation of such immunizations before travel, and to make the necessary accommodation for security rules imposed by government authorities. www.vacationshut.com shall not assume responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by customer’s health practitioner on a valid vaccination certificate, which the customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the USA State Department Web site travel.state.gov, for relevant information relating to travel to specific destinations, and the USA Centers for Disease Control www.cdc.gov/travel/camerica.htm relating to health issues. For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to your domestic and/or international destination(s), and re-entry into the United States visit www.tsa.gov, www.dot.gov, www.faa.gov.us, www.ustreas.gov, www.cbp.gov Please note that USA rules regarding entry and exit change on a daily basis. RESPONSIBILITY AND DISCLOSURE:

www.vacationshut.com is not the source or supplier of the travel services requested and acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services abroad. Each of these companies is an independent entity with its own management, and is not subject to the control of www.vacationshut.com. Customer is advised that the suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are contained in printed form and/or on their respective Web sites governing the transaction. All bookings are accepted by www.vacationshut.com as agent for independent overseas ground and tour operators on your itinerary. The transportation, accommodations and other services provided by the identified sea, ground, and air operators offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers, including Terms and Conditions on their respective Web sites. Because www.vacationshut.com does not have the right to control the operations of the independent operators and their suppliers, www.vacationshut.com IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, which may arise out of these services. www.vacationshut.com is not responsible for the willful or negligent acts and/or omissions of such suppliers or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services. Customer’s retention of travel documents, reservations, or bookings after issuance shall constitute consent to the above, and further, that www.vacationshut.com shall not be liable for any accident, injury, property damage, or personal loss to Customer or to those traveling with Customer in connection with any accommodations, transportation, or other travel services or resulting directly or indirectly from any occurrences or conditions beyond its control, including, but not limited to fuel increases. Weather conditions, including but limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of the control of www.vacationshut.com. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by third party suppliers, which is beyond the control of www.vacationshut.com. www.vacationshut.com reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary or desirable, to refuse to accept or to retain as a member of any tour any person at any time, and to pass on to customers any expenditure occasioned by delays or events beyond its control. In case of any appreciable variation in its cost, www.vacationshut.com reserves the right to adjust its rates. www.vacationshut.com has solely received a commission and perhaps a service fee for this transaction and Customer agrees and understands that any recovery from www.vacationshut.com will be limited to the commission and service fee actually received by www.vacationshut.com.

FORCE MAJEURE

“Force Majeure” means, in relation to www.vacationshut.com, any circumstances beyond the reasonable control of www.vacationshut.com, (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences).

www.vacationshut.com shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.

If www.vacationshut.com, and/or any of its’ travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by www.vacationshut.com to you as a result of the non-performance of any obligations hereunder shall remain in its sole and absolute discretion, although www.vacationshut.com shall use its reasonable efforts to reimburse you where possible. However, www.vacationshut.com shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to www.vacationshut.com of the Force Majeure and applicable cancellation fees.

Regarding civil unrest, once www.vacationshut.com has investigated the prevailing situation, as it deems fit, it shall remain in www.vacationshut.com’s sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to each supplier’s terms and conditions.

INSURANCE

www.vacationshut.com recommends you purchase travel insurance, this can help protect you from financial loss. www.vacationshut.com is not responsible for cancellation, emergency evacuation, accidents abroad, illness, lost luggage, flight mishaps, weather conditions, volcanic eruptions and thus recommends that you purchase available insurance coverage at an additional charge. www.vacationshut.com recommends you purchase the following types of insurance:

  • Trip Cancellation
  • Trip Interruption
  • Emergency Medical Expenses
  • Emergency Evacuation/Repatriation of Remains
  • Trip Delay
  • Baggage & Personal Effects
  • Baggage Delay and more
ALTERATIONS IN TRAVEL PLANS

Alterations in itinerary may be necessitated for any number of reasons, including but not limited to severe weather at the sole discretion of www.vacationshut.com and subject to supplier terms and conditions. If a property, supplier, activity, or area is deleted for any reason, it may be replaced with a comparable one.
